Description

GENERAL ITEMS

9. APPROVAL OF THE STUDENT AND FAMILY HANDBOOK FOR 2009-2010
Description
In order to consolidate District information in a user friendly manner, the Code of Student Conduct and the Parent Guide are consolidated into one Student and Family Handbook.  The handbook contains information related to District and School policies, procedures, rights and responsibilities.  The format of the 2009-2010 Student and Family Handbook uses two columns for easier reading.  Sections and subsections are identified using a letter-and-number system to make information easier to locate.

Recommendation
That the Board approves the Student and Family Handbook for 2009-2010.

10. APPROVAL OF THE DISTRICT ENGLISH LANGUAGE LEARNER (ELL/LEP) PLAN 2009-2011
Description
The District ELL/LEP Plan explains how educational opportunities and services are provided to English Language Learners in Sarasota County.

AGREEMENTS/CONTRACTS

11. APPROVAL OF AGREEMENT WITH SARASOTA COUNTY, FLORIDA
Description
This agreement will allow for non-paid career technical work experience for Exceptional Student Education Students from Booker High School, North Port High School, Oak Park School, Riverview High School, Sarasota High School, and Venice High School, ages 16 to 22 years of age, in 10th through 12th grades, to learn the day to day business operations at Sarasota County, Florida.

Recommendation

That the School Board approve the agreement between the Vocational Instructional Program and Sarasota County, Florida, as presented.

12. APPROVAL OF THE AGREEMENT BETWEEN THE STATE OF FLORIDA DEPARTMENT OF TRANSPORTATION (DOT) AND THE SARASOTA COUNTY SCHOOL BOARD
Description
The Department of Transportation has agreed to provide bicycles and a storage trailer for use by the School Board as part of its participation in the Safe Routes to School Program by providing bicycle-use awareness and education to students throughout Sarasota County.

Recommendation

That the School Board approve the agreement between the State of Florida Department of Transportation and the Sarasota County School Board.

13. APPROVAL OF RENEWAL OF AGREEMENT WITH MICROSOFT FOR SELECT VOLUME PURCHASES AND A NEW AGREEMENT FOR SCHOOL VOLUME LICENSE PURCHASES THROUGH EDUCATION RESOURCES
Description
The renewal of Select Agreement allows all schools and departments to purchase Microsoft application software at substantial discounts over the next 3 years.  The School Agreement will be utilized for all purchases of Microsoft products included as part of our Phase I Computer Refresh.  This will enable the district to purchase software, obtain renewals, and pay over the 3 year period at a substantial savings.  The district is now able to take advantage of this agreement as inventories of equipment are now clearly identified and standardized at these Phase I sites.  Remaining locations will continue to utilize the Select Agreement until such time that these locations are refreshed and standardized.

Recommendation
It is recommended that the Board approve the Microsoft Select renewal and School Agreements.

14. RESCISION OF CONTRACT FOR SALE OF SURPLUS PARCEL
Description
On June 17, 2008, the School Board approved a contract to sell a 25-foot strip of surplus land adjacent to Emma E. Booker Elementary School for use by a local developer as water retention.  The proposed buyer has failed to proceed with the project and has indicated that he can no longer purchase the parcel.

Recommendation
That the School Board of Sarasota County rescind the contract of June 17, 2008, with Owen Properties, Inc.

GRANTS

15. APPROVAL OF THE CARL D. PERKINS POSTSECONDARY CAREER & TECHNICAL EDUCATION GRANT APPLICATION TO THE FLORIDA DEPARTMENT OF EDUCATION FOR ALL POSTSECONDARY CAREER AND TECHNICAL PROGRAMS
Description

ENTITLEMENT: Grant funds of $90,001 will provide supplemental funding for the enhancement of postsecondary Career and Technical Education.



Recommendation

That the School Board of Sarasota County approve the Carl D. Perkins Postsecondary Career & Technical Education grant application.

FIELD TRIPS

16. APPROVAL OF THE PINE VIEW SCHOOL FIELD TRIP TO BIRMINGHAM, ALABAMA, ON JUNE 14, 2009 THROUGH JUNE 20, 2009
Description
Students of Speech I and Debate II classes compete in district, state and national speech and debate contests.  All students are invited to participate and belong to the Speech and Debate team by competing in speaking contests and earn membership privileges in the Catholic Forensic League, Florida Forensic League, and National Forensic Leagues.

Recommendation
That the Pine View School field trip to Birmingham, Alabama, on June 14, 2009 through June 16, 2009, be approved.

EXPULSIONS

17. APPROVAL OF STUDENT EXPULSION ABEYANCE CASE NO. 09-298
Description
School Board Policy 5.34(4) permits the Board to hold in abeyance the expulsion of a student if the student participates in a recognized alternative-to-expulsion program.  This student is being placed in an alternative placement.

Recommendation
That Expulsion Case No. 09-298 be held in abeyance per School Board Policy 5.34.

18. APPROVAL OF EXPULSION CASE NO. 09-059
Description

The student listed in Expulsion Case No. 09-059 is in violation of an accepted Expulsion Settlement Agreement for alternative school placement.  On October 7, 2008, the student listed in Expulsion Case No. 09-059 violated School Board Policy 5.34(1)(d), Sexual Misconduct, Battery.  It is the recommendation of the Superintendent that the student be expelled from the Sarasota County Schools until October 23 of the 2009-2010 academic year.



Recommendation

That in accordance with provisions of Sections 1006.07 (1)(a)(b), Florida Statutes and School Board Policy 5.34, and the holding of a hearing having been waived by the student/parent, the recommendation as specified in Expulsion Case No. 09-059 to expel the student referenced therein from the Sarasota County Schools be approved effective immediately for the remainder of the 2008-2009 academic year, the 2009 summer session, until October 23 of the 2009-2010 academic year.

19. APPROVAL OF EXPULSION CASE NO. 09-378
Description

The student listed in Expulsion Case No. 09-378 violated School Board Policy 5.322, Prohibition Against Use, Sale, or Possession of Alcohol or Drugs or Paraphernalia, and School Board Policy 5.32, Zero Tolerance(1)(j), Possession, Use, or Sale of Controlled Substances.  It is the recommendation of the Superintendent that the student be expelled from the Sarasota County Schools until May 30 of the 2009-2010 academic year



Recommendation

That in accordance with provisions of Sections 1006.07 (1)(a)(b), Florida Statutes and School Board Policy 5.34, and the holding of a hearing having been waived by the student/parent, the recommendation as specified in Expulsion Case No. 09-378 to expel the student referenced therein from the Sarasota County Schools be approved effective immediately for the remainder of the 2008-2009 academic year, the 2009 summer session, and the entire 2009-2010 academic year.

Description

The student listed in Expulsion Case No. 09-344 is in violation of an accepted Deferred Settlement Agreement for school placement.  On March 19, 2009, the student listed in Expulsion Case No. 09-344 violated School Board Policy 5.322, Prohibition Against Use, Sale, or Possession of Alcohol or Drugs.  It is the recommendation of the Superintendent that the student be expelled from the Sarasota County Schools until March 23 of the 2009-2010 academic year.



Recommendation

That in accordance with provisions of Sections 1006.07 (1)(a)(b), Florida Statutes and School Board Policy 5.344, and the holding of a hearing having been waived by the student/parent, the recommendation as specified in Expulsion Case No. 09-344 to expel the student referenced therein from the Sarasota County Schools be approved effective immediately for the remainder of the 2008-2009 academic year, the 2009 summer session, until March 23 of the 2009-2010 academic year.

21. APPROVAL OF EXPULSION CASE NO. 09-160
Description

The student listed in Expulsion Case No. 09-160 is in violation of an accepted Expulsion Settlement Agreement for alternative school placement.  On November 6, 2008, the student listed in Expulsion Case No. 09-160 violated School Board Policy 5.34 (1)(d), Theft.  It is the recommendation of the Superintendent that the student be expelled from the Sarasota County Schools until May 29, 2009.



Recommendation

That in accordance with provisions of Sections 1006.07 (1)(a)(b), Florida Statutes and School Board Policy 5.34, and the holding of a hearing having been waived by the student/parent, the recommendation as specified in Expulsion Case No. 09-160 to expel the student referenced therein from the Sarasota County Schools be approved effective immediately for the remainder of the 2008-2009 academic year.

MATERIALS MANAGEMENT

22. APPROVAL TO AWARD BID #9120 FOR TOILET PARTITIONS - SUPPLY AND INSTALL
Description
Bids to provide 'Toilet Partitions - Supply and Install' were received from two vendors on April 23, 2009.  The bid of Scranton Products was the best low bid meeting the advertised specifications.  This bid is for a period of one year with the option to renew for two additional one-year periods.  Funds for these purchases are contained in the capital budget allocated to the Facilities Services Department.


Recommendation
That the bid of Scranton Products to provide 'Toilet Partitions - Supply and Install' in an amount not to exceed $50,000.00, be approved for award and purchase.

23. APPROVAL TO PURCHASE OFFICE AND CLASSROOM FURNITURE ON STATE CONTRACT
Description
The Materials Management Department requests permission to purchase office and classroom furniture from The Hon Company on the State of Florida Furniture Contract #425-001-06-1.  Consolidating purchases under this agreement will result in additional discounts ranging from 5% to 17%.  The funds for these purchases are contained in the capital budgets for new construction and individual cost center budgets.

Recommendation
That the purchase of furniture from The Hon Company, in an amount not to exceed $500,000.00, be approved for purchase.

24. APPROVAL TO AWARD BID #9148 FOR HARV MATERIALS
Description
Bids to provide 'HARV Materials' (heating, air conditioning, refrigeration and ventilation) were received from two vendors on April 29, 2009.  The bids of Johnstone Supply and Tampa Bay Trane were the best low bids meeting the advertised specifications.  This bid is for a period of one year with the option to renew for two additional one-year periods.  Funding for these purchases are contained in the capital budget allocated to the Facilities Services Department.                                                         

Recommendation
That the bids of Johnstone Supply and Tampa Bay Trane, to provide 'HARV Materials' in an amount not to exceed $500,000.00, be approved for award and purchase.

25. ACCEPTANCE OF FACILITIES SERVICES' PROJECT(S) COMPLETION AND APPROVAL OF FINAL PAYMENT TO CONTRACTOR(S)
Description

CONSTRUCTION

27. APPROVAL OF THE BILL OF SALE TO THE CITY OF NORTH PORT, FLORIDA, FOR THE WATER DISTRIBUTION SYSTEM, WASTEWATER COLLECTION SYSTEM, AND LIFT STATION AT ATWATER ELEMENTARY SCHOOL (AKA ELEMENTARY "I")
Description
The City of North Port land development regulations require the ownership of the utility systems be vested with the City.  This item authorizes the transfer of title of these facilities to the City of North Port. The School Board attorney has reviewed and approved this Bill of Sale.

Recommendation
That the Bill of Sale to the City of North Port, Florida, for the water distribution system, wastewater collection system, and lift station at Atwater Elementary School (aka Elementary "I") be approved as presented.

28. APPROVAL OF CONTRACT FOR CONSTRUCTION FOR THE LAKEVIEW ELEMENTARY SCHOOL - BUS LOOP PROJECT
Description

Under the terms of the 1/6/2009 (Item #30) Board approved "Agreement between Owner and Construction Manager for Pre-Construction & Bidding Services", the Executive Director of Construction Services and a member of the Professional Services Selection Committee (PSSC) have successfully negotiated a contract with P.J. Hayes, Inc. (dba Tandem Construction) for the Lakeview Elementary School - Bus Loop project.  The 1/6/2009 agreement included pre-construction and bidding services only.  This Contract for Construction includes construction of a new bus loop, kitchen grease traps and sanitary drainage, and related site work in preparation for the next phase of the project.  This is the first phase of the multi-phased project for the Lakeview Elementary School - Administration/Cafetorium/Wing 100 project.  Separate contracts will be negotiated at later dates for the remaining phases of this project.  The Guaranteed Maximum Price (GMP) of this contract is $806,844.00.  This contract is available for review at the Construction Services Department.  The School Board attorney has approved the use of this contract.  Funds for this contract are available in the project budget account.



Recommendation
That the Contract for Construction for the Lakeview Elementary School - Bus Loop project be approved as presented.

FINANCE

30. APPROVAL OF THE SUPERINTENDENT'S FINANCIAL STATEMENT FOR THE MONTH ENDING MARCH 31, 2009
Description
The Superintendent's Financial Statements for the month ending March 31, 2009, does not reflect any unexpected trends for the 2008-09 fiscal year.  The General Fund currently shows a fund balance of approximately $114.9 million.  However, budgeted deficit spending in the General Fund in future months will decrease this balance as the fiscal year ends, due to State revenue shortfalls and reduced property tax revenues.  The Food Service Fund revenues overall continue to be flat.  The money the District receives through the Free and Reduced Meals Program has increased approximately 16%, but revenues received from students paying full price or purchasing al a carte meals has decreased almost 10%.  Expenditures have remained steady from the prior year.  The District made an arrangement with the Tax Collector in December for their office to invest some of the District tax revenue money since they are receiving a better interest rate than the District.  This is the cause of the large Due from Other Agencies amount in both the General and Capital Projects Funds.
